Terms of Service
Last updated: October 13, 2026
These terms apply to your use of proexcavationtoronto.ca and to requests for site visits and quotes from Pro Excavation Toronto. Work we perform is governed by the written contract you sign with us; if that contract and these terms conflict, the contract wins.

2. Website Information
Content on this website, including price ranges, timelines, regulations and project examples, is general information to help you plan. It is not engineering advice, legal advice or a quote. Prices shown are typical ranges in Canadian dollars before HST and can change. Your project's scope and price are set only by a written quote issued on our letterhead after a site visit.
3. Site Visits and Quotes
- Site visits are free and carry no obligation.
- Written quotes are valid for the period stated on the quote, usually 30 days, because material, disposal and permit costs change.
- Quotes are based on conditions visible or reasonably expected at the time of the visit and on the information you provide. Concealed conditions, such as buried debris, unmapped utilities, contaminated soil or foundation defects that could not be seen, are handled under the change process in your contract.
4. Contracts, Payments and Changes
Projects proceed under a signed fixed-price contract with a 5-stage draw schedule tied to permit, excavation, structural, backfill and final sign-off, unless the contract states otherwise. No change to scope or price takes effect without a written change approval signed by you. Payment terms, holdback under Ontario's Construction Act and accepted payment methods are set out in your contract.
5. Permits, Engineering and Approvals
Where our contract includes them, we prepare and file permit applications and engineering drawings. Approval timelines are set by municipal building departments, the Committee of Adjustment, conservation authorities and utilities, which are outside our control. We will tell you about expected timelines and any delays as soon as we know of them.
6. Access, Utilities and Neighbours
You agree to give us safe access to the work area during agreed hours and to tell us about anything you know that may affect the work, such as private underground lines, past repairs or disputes with neighbours. We request Ontario One Call locates before excavation; privately owned lines not shown on locates or disclosed to us are the owner's responsibility to identify, and we can locate and daylight them on request.
7. Scheduling and Cancellation
Start dates depend on permits, utility disconnects, weather and site conditions. If you need to cancel or postpone after signing, please tell us as early as possible. Costs already incurred, such as engineering, permits and mobilization, are payable as set out in your contract.
8. Warranty
Our workmanship warranty and any Tarion coverage are described in your contract. Warranty does not cover damage caused by others, by misuse, or by conditions outside the scope of our work.
9. Insurance
We carry commercial general liability insurance of $5,000,000 and maintain WSIB clearance. Certificates are provided at contract signing.
10. Limitation of Liability
To the extent permitted by law, Pro Excavation Toronto is not liable for indirect, incidental or consequential losses arising from use of this website or reliance on its general information. Our liability for work performed is governed by your contract and applicable Ontario law.
11. Intellectual Property
Text, graphics, logos, photos and other content on this website belong to Pro Excavation Toronto or are used with permission. Please do not copy or reuse them without our written consent.
12. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
